1. Acceptance of Terms

By downloading, installing, or using Flex ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Flex is an iOS application designed to help users learn Spanish verb conjugations through spaced repetition and interactive practice. The App includes features such as:

  • Spaced repetition study sessions using the FSRS algorithm
  • Comprehensive Spanish verb conjugation database
  • Speech recognition for pronunciation practice
  • Progress tracking and statistics
  • Regional dialect support (voseo and other variations)

3. License and Restrictions

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

3.2 Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Copy, distribute, or create derivative works from the App
  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the App or its systems
  • Remove, alter, or obscure any proprietary notices on the App

4. User Accounts and Data

4.1 Account Responsibility

If you create an account or use iCloud sync features, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Data Accuracy

While we strive to provide accurate conjugation data and educational content, we do not guarantee that all information in the App is error-free or complete. Users should verify critical information through additional sources.

5. Purchases and Subscriptions

5.1 In-App Purchases

Certain features of the App may require payment. All purchases are processed through Apple's App Store and are subject to Apple's Terms of Service and refund policies.

5.2 Subscriptions

If you purchase a subscription:

  • Your subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage or cancel your subscription in your App Store account settings

5.3 Refunds

Refund requests are handled by Apple according to their policies. We do not process refunds directly.

6. Intellectual Property

The App, including all content, features, functionality, design, code, and materials, is owned by Flex and is protected by copyright, trademark, and other intellectual property laws. The conjugation data, user interface, and all other materials are proprietary to Flex or its licensors.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to our privacy practices as described in the Privacy Policy.

8. Disclaimers and Limitation of Liability

8.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers or any personal information stored therein
  • Any bugs, viruses, or other harmful code that may be transmitted through the App
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted or shared through the App

9. Educational Purpose

Flex is an educational tool designed to supplement your Spanish language learning. It is not a substitute for comprehensive language instruction, immersion, or professional language education. Users are encouraged to use the App as part of a broader language learning strategy.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

11. Termination

We may suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Severability
